Terms of Use

These terms are an agreement between you and LeptonO Inc. (“we”, “us”) for your use of the DunShine mobile game. By installing or playing the game, you agree to them. If you don’t agree, please don’t play.

Who can play

DunShine is meant for players aged 13 and over. If you’re under the age of majority where you live, please make sure a parent or guardian has read and agreed to these terms with you.

Where you got the game

DunShine is available for Android on Google Play. If you got it there, the Google Play Terms of Service also apply to your download. Google is not a party to these terms and is not responsible for the game or its support.

If you get DunShine from the Apple App Store, Apple’s Licensed Application End User License Agreement governs your licence to the game. These terms apply alongside it, and where the two conflict, Apple’s agreement wins.

Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to play DunShine on devices you own or control, for your own entertainment. You may not copy, modify, resell, rent or reverse engineer the game, or extract its art, models, music or code, except where the law allows it.

Free to play, supported by ads

DunShine is free to download and play. It shows ads served by Google AdMob, as described in our Privacy Policy.

  • Rewarded ads are optional. Some offers give you an in-game bonus for watching an ad. You can always decline. A reward is given only after the ad finishes, and only if an ad is available — that depends on your connection and on Google, and isn’t guaranteed.
  • Limits. Each ad offer has its own cooldown and daily limit. We may change which bonuses are offered, how big they are and how often they appear.
  • Interstitial ads. A short ad may play when you go back to the map after clearing a level.
  • Ads come from third parties. We don’t control the content of individual ads or the products they advertise. Anything you buy from an advertiser is between you and them.

Coins, Sparkles and other in-game items

Coins, Sparkles, head starts, upgrades and other in-game items are part of the game, not property. They have no real-world value, can’t be exchanged for money or anything outside the game, and can’t be sold or transferred. We may rebalance, change or remove them as the game is updated. DunShine currently has no in-app purchases; if we add any, they’ll be sold through the app store, and its billing and refund rules will apply.

Your saved progress

Your progress is saved only on your device. We don’t keep a copy, so we can’t restore it if your phone is lost, damaged or reset, or if the game is uninstalled or its storage is cleared.

Play fair

When you play DunShine, please don’t:

  • use cheats, bots, modified versions of the game or tools that change how it works;
  • interfere with the ads — for example by tapping ads you’re not interested in, automating ad views or trying to collect rewards without watching;
  • try to break, overload or get around the game’s security or limits; or
  • use the game in a way that breaks the law.

Ownership

The game, its characters, art, music, sounds, code and the DunShine name and logo belong to LeptonO Inc. or its licensors. Some parts of the game, such as the game engine and some sound effects, are provided by third parties under their own licences; they’re credited in the game under Credits.

Changes and availability

We may update the game, add or remove features, levels or worlds, or stop offering it. Some updates may be needed to keep playing. If we make a material change to these terms, we’ll update this page and the date at the top. Continuing to play after that means you accept the new terms.

Disclaimer

The game is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties that it will be error-free or uninterrupted, that it will run on every device, or that ads or rewards will always be available.

Limitation of liability

To the fullest extent the law allows, LeptonO Inc. is not liable for any indirect, incidental or consequential loss, or for lost data or progress, arising from your use of the game. Because DunShine is free, our total liability to you for any claim is limited to CAD $10. Nothing in these terms limits rights you have under consumer protection laws that can’t be excluded.

Ending these terms

You can stop playing at any time by deleting the game. If you break these terms, your licence to play ends.

Governing law

These terms are governed by the laws of Canada, without regard to conflict-of-law rules.
